Please read these Terms & Conditions (“Terms”) carefully before using the website wearyourdrip.in (the “Website”) and any related mobile site or application (collectively, the “Platform”). These Terms form a legally binding agreement between you (“you”, “your”, “User”, “Customer”) and WEAR YOUR DRIP (WYD) (“WYD”, “we”, “us”, “our”). By accessing or using the Platform, placing orders or otherwise interacting with WYD, you accept and agree to these Terms.
1 Electronic Record & Applicability
- This electronic record is generated by a computer system and does not require any physical or digital signature in accordance with the Information Technology Act and rules framed thereunder.
- These Terms apply to all Users of the Platform including browsers, customers, merchants, contributors of content and other users.
2 Acceptance & Changes
- Your use of the Platform constitutes acceptance of these Terms. WYD may modify or update these Terms at any time by posting the revised version on the Platform with an updated effective date. Continued use after changes constitutes acceptance of the revised Terms. It is your responsibility to review Terms periodically.
3 Eligibility
- You must be at least 18 years old and competent to contract under applicable law to use the Platform. Minors may use the Platform only under parental or guardian supervision.
4 User Account & Accuracy of Information
- If you register, you agree to provide true, accurate and complete information and to keep your account information up to date. You are responsible for all activity on your account and for maintaining confidentiality of your password. Notify us immediately of any unauthorized use.
- You consent to receiving communications (emails, SMS, WhatsApp) from WYD regarding orders, offers and transactions.
5 Orders, Contract Formation & Acceptance
- Placing an order on the Platform is an offer to buy. WYD will send an order acknowledgement on receipt of your order. Order acceptance and formation of contract occur only upon WYD’s dispatch confirmation. WYD reserves the right to refuse or cancel any order for reasons including stock unavailability, pricing errors, suspected fraud, or failure to verify payment.
6 Pricing & Payment
- Product prices shown on the Platform are in INR and as displayed at the time of order. WYD may change prices at any time prior to order acceptance. For international orders, customs, duties and local taxes are the buyer’s responsibility.
- We accept the payment methods displayed at checkout. Payments will be processed through third‑party payment gateways; their terms also apply. Refunds will be made to the original payment method unless otherwise specified.
7 Shipping, Delivery, Risk & Title
- Shipping and delivery details are governed by our Shipping Policy available on the Platform. Delivery timelines are estimates only and may be affected by courier performance, customs (for international orders), weather and other factors.
- Risk of loss or damage passes to you upon delivery. Title passes as per invoice and payment terms.
- Return, Exchange & Refunds
- Returns, exchanges and refunds are governed by our Exchange / Return & Refund Policy published on the Platform. Please refer to that policy for eligibility, timelines and procedures.
8 Product Information & Availability
- WYD makes reasonable efforts to display accurate product information (sizes, colours, specifications). However, product images may be enhanced in post-production and actual colours may vary. WYD does not guarantee availability of any product until order is accepted.
9 Intellectual Property
- All content on the Platform including trademarks, logos, designs, text, images and code is the property of WYD or duly licensed to WYD. No material may be reproduced, modified, republished, uploaded, posted or distributed in any way without WYD’s prior written consent.
10 User Content & License
- By posting content (reviews, images, comments) on the Platform you grant WYD a worldwide, royalty‑free, transferable, sub‑licensable, non‑exclusive license to use, reproduce, adapt, publish, translate, distribute, display and create derivative works of such content for any purpose related to the business (including marketing). You represent and warrant you own or have permission to use such content and its use does not infringe any third‑party rights.
11 Prohibited Activities
- You shall not (and shall not assist others to) use the Platform for unlawful purposes, post defamatory or obscene content, infringe IP rights, upload malware, attempt unauthorized access, or interfere with the Platform’s operation. WYD reserves the right to suspend or terminate accounts for violations.
12 Third‑party Links & Services
- The Platform may contain links to third‑party websites and services. WYD does not control or endorse third‑party content and is not responsible for their terms, privacy practices or performance. Transactions with third parties are at your risk.
13 No Warranty
- The Platform and Services are provided “as is” and “as available”. WYD disclaims all warranties (express or implied) including merchantability, fitness for a particular purpose, non‑infringement and uninterrupted availability to the fullest extent permitted by law.
14 Limitation of Liability
- To the maximum extent permitted by law, WYD’s aggregate liability arising from or related to these Terms, the Platform, or Services will be limited to the amount paid by you for the specific order giving rise to the claim (or INR 100, whichever is lower). WYD will not be liable for any indirect, incidental, consequential, special or punitive damages, including loss of profits, revenue, data or business opportunities.
15 Indemnity
- You agree to indemnify, defend and hold harmless WYD, its officers, directors, employees and agents from and against any claims, losses, liabilities, damages, costs and expenses (including reasonable attorneys’ fees) arising from your breach of these Terms, your use of the Platform, or your violation of any law or third‑party rights.
16 Force Majeure
- WYD shall not be liable for failure or delay in performance due to causes beyond WYD’s reasonable control, including but not limited to acts of God, fire, flood, strikes, pandemics, war, terrorism, government actions, or courier disruptions.
17 Privacy & Data Protection
- WYD’s Privacy Policy explains how we collect, use and share personal data. By using the Platform you consent to processing of your personal data in accordance with that policy.
18 Grievance Redressal
- If you have any complaints or grievances, contact our Customer Support (details below). WYD will acknowledge and attempt to resolve complaints in a timely manner in accordance with applicable law.
19 Termination & Suspension
- WYD may, at its sole discretion, suspend, restrict or terminate your access to the Platform for violation of these Terms, non‑payment, fraud, or other lawful reasons. Termination does not limit WYD’s rights to pursue other remedies.
20 Governing Law & Dispute Resolution
- These Terms are governed by the laws of India. Any dispute arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of courts in [Mumbai / specify city]. Parties may, by mutual agreement, opt for mediation or arbitration as an alternative dispute resolution mechanism.
21 Miscellaneous
- Entire Agreement: These Terms and any policies incorporated by reference constitute the entire agreement between you and WYD regarding the Platform.
- Severability: If any provision is found unlawful or unenforceable, the remaining provisions will remain in full force and effect.
- Waiver: Failure to enforce a provision is not a waiver of rights.
